Binexo, con sitio web binexo.net y correo de contacto contacto@binexo.net, es responsable del tratamiento de los datos personales que usted nos proporciona de forma directa, conforme a la Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP), su Reglamento y demás normativa aplicable en México.Binexo, with website binexo.net and contact email contacto@binexo.net, is responsible for the processing of the personal data you provide to us directly, under Mexico’s Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP), its Regulations and other applicable Mexican rules.
Este aviso cubre dos supuestos que conviene no confundir. El primero son los datos que usted nos entrega directamente al contactarnos: ahí Binexo es el responsable y este aviso lo rige por completo. El segundo son los datos personales que llegamos a tratar mientras operamos la infraestructura de nuestros clientes —imágenes de cámaras, registros biométricos de acceso, bitácoras de red—: en esos casos el responsable es el cliente que nos contrató y Binexo actúa únicamente como encargado, en términos de los artículos 49 a 55 del Reglamento de la LFPDPPP.This notice covers two situations that should not be confused. The first is the data you give us directly when contacting us: there Binexo is the controller and this notice fully governs it. The second is personal data we may process while operating our clients’ infrastructure —camera footage, biometric access records, network logs—: in those cases the controller is the client who hired us, and Binexo acts solely as a processor under articles 49 to 55 of the LFPDPPP Regulations.
Del formulario de contacto recabamos únicamente: nombre, empresa, correo electrónico, teléfono, servicio de interés y el mensaje que usted redacte. Adicionalmente, el servidor registra la dirección IP y la fecha de la solicitud, dato técnico que usamos solo para prevenir abuso del formulario. No recabamos datos patrimoniales ni financieros por este medio, ni datos personales sensibles.From the contact form we collect only: name, company, email address, phone number, service of interest and the message you write. Additionally, the server logs the IP address and date of the request, a technical record used solely to prevent form abuse. We do not collect financial or asset data through this channel, nor sensitive personal data.
Por la naturaleza de lo que hacemos, al ejecutar un proyecto podemos tener contacto con datos personales de terceros. Concretamente: en videovigilancia, las imágenes y el video de las personas que circulan por las instalaciones del cliente; en control de acceso, datos biométricos como huella o rostro, números de credencial y registros de entrada y salida; en telecomunicaciones, direcciones IP, bitácoras de conexión y datos de tráfico necesarios para operar y dar soporte al enlace; y en ciberseguridad, soporte y desarrollo, bitácoras de sistemas, cuentas de usuario y, cuando el proyecto lo exige, bases de datos del cliente.Given the nature of our work, while executing a project we may come into contact with third parties’ personal data. Specifically: in video surveillance, images and video of people moving through the client’s facilities; in access control, biometric data such as fingerprint or face, credential numbers and entry and exit records; in telecommunications, IP addresses, connection logs and traffic data required to operate and support the link; and in cybersecurity, support and development, system logs, user accounts and, when the project requires it, the client’s databases.
En todos esos casos tratamos los datos únicamente por instrucción del cliente. No los usamos para fines propios, no los incorporamos a bases de datos de Binexo, no los transferimos a terceros, guardamos confidencialidad aun después de terminada la relación contractual, y al concluir el contrato los devolvemos o suprimimos según se haya pactado. Los datos biométricos son datos sensibles conforme a la LFPDPPP y reciben tratamiento reforzado: acceso restringido, cifrado y bitácora de consultas.In all those cases we process data solely on the client’s instructions. We do not use it for our own purposes, do not add it to Binexo databases, do not transfer it to third parties, maintain confidentiality even after the contractual relationship ends, and upon termination we return or delete it as agreed. Biometric data is sensitive data under the LFPDPPP and receives reinforced treatment: restricted access, encryption and access logging.

Cuando instalamos cámaras o lectores biométricos, es el cliente —como responsable de sus instalaciones— quien debe informar a empleados y visitantes mediante su propio aviso de privacidad y colocar la señalización visible que exige la normativa. Binexo configura los sistemas para que la retención de grabaciones y registros se ajuste al plazo que el cliente defina y para que el acceso quede restringido al personal que él autorice.When we install cameras or biometric readers, it is the client —as controller of their facilities— who must inform employees and visitors through their own privacy notice and post the visible signage required by regulation. Binexo configures the systems so that retention of recordings and records matches the period defined by the client, and so that access is restricted to the personnel they authorize.
Si usted fue captado por una cámara o registrado por un lector instalado por nosotros y desea ejercer sus derechos, la solicitud debe dirigirse al titular de las instalaciones. Si nos escribe a nosotros, la canalizamos con el cliente responsable dentro de los cinco días hábiles siguientes.If you were captured by a camera or registered by a reader we installed and wish to exercise your rights, the request must be addressed to the owner of the facilities. If you write to us, we will forward it to the responsible client within the following five business days.
Binexo no vende ni comercializa datos personales. Ahora bien, nuestra infraestructura de telecomunicaciones opera entre México y Estados Unidos, por lo que el tráfico de red de un cliente que contrata cruce internacional puede cursar por equipos y direcciones IP ubicados en Estados Unidos: eso es inherente al servicio contratado y así se hace constar en el contrato correspondiente. Fuera de ese supuesto, solo compartimos datos con proveedores de hospedaje y correo que actúan como encargados bajo obligaciones de confidencialidad, o cuando lo exige la ley conforme al artículo 37 de la LFPDPPP.Binexo does not sell or commercialize personal data. That said, our telecommunications infrastructure operates between Mexico and the United States, so the network traffic of a client contracting international crossing may pass through equipment and IP addresses located in the United States: this is inherent to the contracted service and is stated in the corresponding agreement. Beyond that, we only share data with hosting and email providers acting as processors under confidentiality obligations, or when required by law under article 37 of the LFPDPPP.

Los datos del formulario se conservan mientras exista relación comercial y hasta veinticuatro meses después del último contacto, salvo que una obligación legal —fiscal, por ejemplo— exija conservarlos más tiempo. Los datos que tratamos por cuenta de un cliente se conservan por el plazo que él determine en el contrato.Form data is retained while a commercial relationship exists and for up to twenty-four months after the last contact, unless a legal obligation —tax, for instance— requires longer retention. Data processed on behalf of a client is retained for the period they set in the contract.
